The petitioners seek bail in anticipation of their arrest in connection with Bihta P.S. Case No. 627 of 2019 instituted for the offences under Sections 302, 34, 120(B) of the Indian Penal Code.

Though there is only suspicion against the petitioners of having killed the deceased because of an old enmity and which occurrence has not been witnessed by anyone but the anticipatory bail of similarly situated

Patna High Court CR. MISC. No.74294 of 2019(2) dt.11-12-2019 2/2 co-accused persons have been rejected by a Bench of this Court vide order dated 04.12.2019 passed in Cr. Misc. No. 63729 of 2019.

Considering this aspect of the matter, I am not inclined to grant anticipatory bail to the petitioners. Should the petitioners surrender before the Court below and seek bail, the same shall be considered in its own merits without being prejudiced by the fact that the present petition has not been entertained.
