2. The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 324, 346, 372, 376, 420, 307, 506, 34 of the Indian Penal Code, Section 27 of the Arms Act, Section 5 and 6 of Immoral Traffic (Prevention) Act and Sections 4, 6 of the POCSO Act.
3. Petitioner along with other accused persons are said to have conspired, trapped the minor daughter of the complainant in prostitution and immoral trafficking.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that the similarly situated co-accused persons have been granted anticipatory bail by this Court vide order
Patna High Court CR. MISC. No.5302 of 2024(4) dt.26-04-2024 2/2 dated 20.12.2023 passed in Cr. Misc. No. 79418 of 2023. He submits that that petitioner is the mother of co-accused Shabnam Kumari who has already been granted anticipatory bail. He submits that there is general and omnibus allegation levelled against the petitioners. He further submits that petitioner has no criminal antecedent as stated in para-3 of the bail application and she is languishing in judicial custody since 20.08.2023.
5. Learned APP for the State opposes the prayer for bail.
6. Considering the facts and circumstances of the case, let the above named petitioner, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with POCSO Case No. 63 of 2022 arising out of Triveniganj P.S. Case No. 412 of 2022.
