JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 This application, for grant of anticipatory bail, arises out of Chakia P.S. Case No. 262 of 2019, disclosing offences under Sections 379/34 of the Indian Penal Code and Bihar Mineral Prevention of Illegal Mining Transportation Storage Rule, 2003, Section 4/5(a)/SC/8(a) of Bihar Mineral Renovates Concerssion Rule, and 4/40 & M.D. (D.R.) Act, Section 4/21. Allegation as per F.I.R. is that tractor of the petitioner was intercepted with loaded sand and no paper was produced. Submission of learned counsel for the petitioner is that he is owner of the vehicle and he was not present there and he is ready to abide by any condition imposed on him. Heard learned A.P.P. also.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above

No.67994 of 2019(2) dt.25-10-2019 2/2 named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari, in connection with Chakia P.S. Case No. 262 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
