JUSTICE ARUN KUMAR ORAL ORDER 06-04-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Naugachia P.S.Case No. 38 of 2017 registered under Sections 302, 364 and 201/34 of the Indian penal Code. Allegation in brief is that younger brother of the informant, six years old, was missing for more than two months and it is suspected that petitioners have killed his brother because of land dispute, as earlier they killed his parents and remains of skelton were recovered by the side of the road.

Submission is that earlier no case was instituted regarding missing of the brother of the informant for almost two months and only suspicion is raised against the petitioners due to enmity and petitioners are on bail in another case instituted by the informant's

Having considered the aforesaid facts and circumstances, the petitioners, namely, Md. Maksood @ Md. Maksud Alam @ Md. Maksud and Anguri Khatun, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned 2nd ACJM, Naugachia, Bhagalpur in connection with Naugachia P.S. Case No. 38 of 2017.
