The petitioner seeks Chhatapur P.S. Case No. 45 of 2017, registered for offences punishable under Sections 436/34 of the Indian Penal Code.

The allegation against the petitioner and another coaccused is that they set fire of the residential house of the informant and fled away.

Submission of the learned counsel for the petitioner is that there is land dispute between the parties and they have lodged F.I.R. on the same date. It is further submitted that the petitioner has been falsely implicated in this case due to previous enmity and the petitioner has no criminal antecedent against the petitioner.

Learned A.P.P. opposes the prayer for bail.

No.20162 of 2018(2) dt.12-04-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above application is disposed of with a direction to the petitioner surrender in the court below within four weeks of receipt of order and makes prayer for regular bail which will be considered on its own merit on the basis of material available at that time on its own merit without being prejudiced by this order.
