The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, father of deceased (informant) got a call from the mobile of brother-in-law of the deceased that some unknown persons shot his son, on such information informant along with his another son Rupesh Kumar reached at Salempur near a bridge where they saw that his son was being taken by his brother-in-law and two covillagers in a vehicle and during course of treatment he died.

Patna High Court CR. MISC. No.1724 of 2023(4) dt.22-06-2023 2/3 It is submitted that petitioners are not named in the FIR. Name of petitioners transpired during course of investigation. Both parties are own Gotia. It is further submitted that one late Ganga Sagar Sah @ Chhedi Sah has three sons namely, Suraj Kumar Sah, Akash Kumar Sah and Prithvi Sah. The name of wife of late Ganga Sagar Sah @ Chhedi Sah is Mrs. Savita Devi. Late Chhedi Sah has got land of about 12 Kathas near the road and the deceased had given advance of Rs. 5,01,000/- in the month of January, 2021 to Suraj Kumar Sah for purchase of 01 katha of land, but Suraj Kumar did not execute the sale deed, due to this reason informant suspects that Suraj Kumar Sah and others might have killed his son due to land dispute. Save and except suspicion there is no material which show the complicity of petitioners in the alleged occurrence. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in
