2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 406, 409, and 34 of the IPC.

3. As per prosecution case, in light of the order of the District Magistrate, Saharsa, an enquiry was conducted and after inquiry, it was found that petitioner, in collusion with other accused persons, committed irregularities in distribution of Flood Relief Fund. It was found that in preparation of the list of affected families, accused persons did not follow the Standard Operating Procedure (S.O.P.).

4. Learned counsel appearing for the petitioner submits that this petitioner is innocent and has falsely been implicated in this case. Petitioner was Revenue Karamchari in Nauhatta Anchal and after four years of his retirement, enquiry was conducted in the case. Moreover, alleged irregular flood relief has already been recovered from the ineligible beneficiaries. Petitioner claims clean antecedent.

5. Learned counsel for the State opposed the prayer for bail. State has filed counter affidavit stating that after

No.79115 of 2025(8) dt.15-07-2026 2/2 comprehensive enquiry, it was found that petitioner and other accused persons, in league with each other, entered other persons in the list of flood affected persons and thus committed misappropriation of the Government money by supplying the relief to them.

6. Considering the facts of the case, prayer for bail of this petitioner is allowed. In the event of arrest/surrender within a period of eight weeks from today, let this petitioner, named above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Saharsa in Nauhatta Police Station Case No. 142/2024, subject to the conditions laid down under section 482 Bharatiya Nagarik Suraksha Sanhita, 2023.
