The petitioner seeks bail in connection with Lakhisarai P.S. Case no. 401 of 2017 registered under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 38(i), 41(i) of Bihar Prohibition & Excise Act-2016.

936 lts of country made liquor is said to have been recovered from the pick-up van and its driver (petitioner) was apprehended.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He had no knowledge of the contents of the cartoon kept in the vehicle as he was transporting the same

Patna High Court Cr.Misc. No.6918 of 2018(2) dt.12-02-2018 2/2 under the instruction of his owner. He has no criminal antecedent. He has been languishing in custody since 1.11.2017.

Considering the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned 2nd Additional District and Sessions Judge-cum-Special Judge (Excise), Lakhisarai in connection with Lakhisarai P.S. Case no. 401 of 2017.
