The petitioner is apprehending his arrest in connection with Sheosagar (Baddi O.P.) P.S.Case no.307 of 2019 registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per FIR, there is recovery of 14 and odd ltrs. of liquor from the house of the petitioner.

Submission of the learned counsel for the petitioner is that the house is a joint house and he has falsely been implicated in this case and he is accused in such type of cases . Earlier he was accused in a case under Section 307 and other Sections of the Indian Penal Code.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.73514 of 2019(2) dt.21-11-2019 2/2 circumstances, as stated above, this application is disposed of with a direction to the petitioner to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court on its own merit without being prejudiced by the order of this Court and if possible to be disposed of on the same day.

With the aforesaid direction, this application is disposed of.
