2. Petitioner seeks regular bail in connection with Madanpur P. S. Case No. 10 of 2025 in a case registered for the offences punishable under Sections 103(1) read with Section 3(5) of the Bharatiya Nyaya Sanhita.
3. Prosecution case, in brief, is that the petitioner and three others are said to have assaulted the victim, who was a conductor of bus, for dispute over stoppage.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. It is further submitted that four named accused persons including the petitioner are alleged to have assaulted the deceased but doctor has found only one injury on the person of the deceased that
Patna High Court CR. MISC. No.74702 of 2025(2) dt.13-11-2025 2/2 itself falsifies the entire prosecution case. Petitioner is in custody since 11.07.2025. Charge-sheet has already been submitted.
5. However, learned A.P.P. for the State vehemently opposed the bail application.
6. Considering the nature of accusation and period of custody, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad/concerned Court below in connection with Madanpur P. S. Case No. 10 of 2025.
