JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 23-01-2018 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Parbatta P.S. Case No. 433 of 2017 registered under Section 30(A) of the Bihar Excise Prohibition Act.

360 ml of foreign liquor is said to have been recovered from the Scorpio vehicle and the petitioner and other accused Ritesh Kumar were apprehended. The petitioner happens to be the driver of the said vehicle.

It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He happens to be the driver of the vehicle. He has no concern with the seized liquor. Though

Patna High Court Cr.Misc. No.2425 of 2018 (2) dt.23-01-2018 2/2 one criminal case i.e. Parbatta P.S. Case No. 74 of 2017 has been lodged against him, but he has been enlarged on bail in the said case. The petitioner has been languishing in custody since 06.12.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge 1st, Khagaria in connection with Parbatta P.S. Case No. 433 of 2017.
