Petitioner, already in custody, seeks bail in Maniyari PS Case No. 62 of 2017 registered under Section 302/34 of the IPC and Section 27 of the Arms Act.
The allegation in brief is that the informant's nephew, while returning back to home taking one empty gas cylinder, was shot dead by some unknown motorcycle borne miscreants.
Learned Counsel for the petitioner submits that except the confessional statement made by one co-accused there is no material against the petitioner and charge-sheet has been submitted against the petitioner.
Having considered the said facts and circumstances, the petitioner, namely, Kanhai Kumar Thakur @ Kaushal Kumar Thakur @ Kanhai Thakur @ Kanhaiya Kumar Thakur @ Kaushal Kishore Thakur is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Nayan Kumar, Judicial Magistrate, lst Class, Muzaffarpur in connection with Maniyari PS Case No. 62 of 2017.
