Both sides are ready to stay with each other, but the grievance has been raised by opposite party no.2 that she is ready to stay with the petitioner, subject to condition that the petitioner will treat her properly and he would not treat badly with her either mentally or physically. The complain has been made by opposite party no. 2 that the petitioner used to demand Rs.1,00,000/- which the opposite party no.2 is unable to fulfill the same. As per their statement, they are ready to stay with each other.
In such view of the matter, the provisional bail granted to the petitioner is confirmed and this Court directs the
Patna High Court CR. MISC. No.67438 of 2019(4) dt.05-03-2020 2/2 both sides to remain physically present before the concerned Presiding Officer on 23.03.2020 at 12 O'clock and from there, the petitioner would carry his wife i.e. opposite party no.2 and he will keep her in a good manner and will not treat her badly. This Court also directs the Presiding Officer to call them from time to time and enquire from opposite party no.2 about the manner the petitioner is treating with her and at the same time, the court below would also try to find out the behaviour of opposite party no.2 with the petitioner. If the opposite party no.2 finds that the petitioner is not treating properly with her, she is at liberty to file a proper application for cancellation of his bail bond.
