JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-04-2018 As both the above applications arise out of same P.S. Case No. and earlier also they were dismissed by a common order of this Court dated 11.09.2017 passed in Cr. Misc. No. 38136 of 2017, as such, they are clubbed together and are being decided by this common order.
Patna High Court Cr.Misc. No.18337 of 2018 (2) dt.04-04-2018 2/3 Earlier prayer for bail of the petitioners was dismissed with direction to the court below to expedite and conclude the trial within a period of six months and petitioners were given liberty to renew their prayer for bail, if the trial is not concluded within the aforesaid period.
Submission of learned counsel for the petitioners that six months period has already expired and trial has not been concluded and petitioners are in custody since 08.06.2017 and 01.06.2017 respectively.
Considering the aforementioned facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000/- (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM-III, Araria, in connection with Palasi P.S. Case No. 67 of 2017, with following conditions:- (i) One of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioners will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal

No.18337 of 2018 (2) dt.04-04-2018 3/3 of trial and make themselves available as and when required by the court and on the event of failure on their part two appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of their bail bonds.
