Petitioners seek regular bail in Dhamdaha P.S. Case

Patna High Court Cr.Misc. No.1920 of 2018 (3) dt.07-02-2018 2/3 No.192 of 2017, G.R. No.3056 of 2017 instituted for the offence under Sections 302, 201/34 of the I.P.C. and Sections 25(1-b)a, 26, 27 of the Arms Act.

The informant is the grand father (Nana) of the deceased who in his written statement has stated that in the evening of 7.8.2017 my grand son, Dablu Kumar, was called on his mobile by his associates, F.I.R. named accused, namely, Boby Kumar and Rahul Kumar and on being asked by his Nana he told that he was going to bring milk and went missing. Subsequently he was informed by his villager Chandra Deo Mandal that his grand son was lying dead in the field of banana and thereafter F.I.R. was instituted against the aforesaid named accused. Submission of the counsel for the petitioners is that the petitioners are not named in the F.I.R. and their names have surfaced during investigation on the basis of confessional statement of co-accused, Phulchand Mandal. The petitioners are in custody since 09.09.2017 having clean antecedent.

Considering the facts and circumstances of the case, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the C.J.M., Purnea, in Dhamdaha P.S.Case No.
