JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Majhaulia P.S. Case No. 45 of 2019, registered for the offences punishable under Section 30 (a) of Bihar Prohibition and Excise Act 2016.

As per F.I.R total 1000 liters spirit was recovered for manufacturing the liquor but nobody arrested or named in the F.I.R. During course of investigation name of the petitioner transpires.

Submission of the learned counsel for the petitioner is that petitioner is not name in the F.I.R and except information of spy nothing is against him. Later on some co-accused have been arrested and on their confessional statement they have named several persons including the name petitioner. Petitioner has no criminal antecedent.

Having heard both sides, considering the above submission, this application allowed. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise Act, Bettiah, West Champaran, in connection with Majhaulia P.S. Case No.-45 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
