2. The petitioner seeks bail in connection with Dehri Nagar P.S. Case No. 746 of 2021 registered for the

Patna High Court CR. MISC. No.75466 of 2024(5) dt.19-09-2025 2/3 offence under Sections 302/34 of the Indian Penal Code and under Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner and others are accused of killing the deceased.

4. The petitioner is in custody since 26.07.2024.

5. It has been submitted by the learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case and other accused persons namely Sanat Kumar Singh, Mantu Giri and Vishal Paswan, who had faced trial and their trial has already been concluded.

6. The name of the petitioner has surfaced in this case on the basis of self-inculpatory statement of Sanat Kumar Singh.

7. Considering the aforesaid facts and the period of custody of the petitioner, this application is allowed.

8. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Dehri-on-Sone, Rohtas/concerned Court below in connection with Dehri Nagar P.S. Case No. 746 of 2021.

9. As a condition of this order, the petitioner, after

No.75466 of 2024(5) dt.19-09-2025 3/3 being released on bail is directed to co-operate in the trial either by appearing personally or through his lawyer in the trial Court on each and every date fixed by the trial Court. Non-compliance of the condition will result in cancellation of the bail bonds of the petitioner.

10. Heard the parties including Shri Jharkhandi Upadhyay, learned counsel for the State.

11. Learned counsel for the petitioner prays for and is permitted to withdraw this application.
