The petitioner seeks bail in a case registered under Section 392 of the Indian Penal Code.
Three motorcycle borne criminals are said to have snatched Rs. 13,38,000/- of the informant on the point of pistol while he was proceeding to deposit said money in the Bank. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He is not named in the F.I.R. There is nothing cogent on record indicating the complicity of the petitioner in the occurrence barring the confessional statement of co-accused namely Bittu Kumar and the petitioner recorded before the
Patna High Court CR. MISC. No.69035 of 2019(2) dt.04-12-2019 2/2 police which have no evidentiary value in the eye of law. No incriminating article has been recovered from the conscious physical possession of the petitioner. Said Bittu Kumar and Coaccused Prakash Kumar have been enlarged on regular bail by different co-ordinate Benches of this Court.
Having regard to the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Darbhanga in connection with Bahadurpur P.S.
