ANJANA MISHRA ORAL ORDER 06-04-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner apprehends his arrest in connection with NH Bangra P.S. Case No. 62/2016 registered for the offences punishable under Sections 379 of the Indian Penal Code. Learned counsel for the petitioner submits that there has been no recovery from the possession of the petitioner but person so arrested in connection with the present case, had made a confessional statement before the police naming the petitioner. It is further submitted that the petitioner has no criminal antecedent and also on the basis of the confessional statement made before the police which has no evidentiary value, the petitioner is apprehending his arrest.

In view of the aforementioned facts and circumstances and

No.16330 of 2018 (2) dt.06-04-2018 2/2 that the petitioner has a clean past, let the petitioner in the event of his arrest / surrender within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the each amount to the satisfaction of the learned A.C.J.M. V, Samastipur, in connection with NH Bangra P.S. Case No. 62/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
