The petitioner is in custody in a case under Sections 307/34 of the Indian Penal Code and Section 27 of the Arms Act.

As per the prosecution case, the FIR has been lodged against four unknown accused persons.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He next submits that nothing looted articles has been recovered from the conscious possession of the petitioner and petitioner has no concern with co-accused Guddu Kumar and no test identification parade has been held. Petitioner is in custody

Patna High Court CR. MISC. No.77840 of 2024(2) dt.07-02-2025 2/2 since 19.01.2024. Similarly situated co-accused persons have been granted bail by a co-ordinate Benches of this Court passed in Cr. Misc. No.56346 of 2023, 75653 of 2023 and 9394 of 2024.

Learned APP for the State opposes the prayer for regular bail of the petitioner.

In view of the fact that similarly situated co-accused persons have also been granted bail by co-ordinate Benches of this Court, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Udakishunganj, DistrictMadhepura in connection with Puraini P.S. Case No. 234 of 2022.
