The petitioner apprehends arrest in a case registered for the offence punishable under sections 365/364/302/120B/34 of the Indian Penal Code.

Prosecution case is that son of the informant went missing leading to registration of the instant case against unknown persons.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Only material that has come in course of investigation is that the informant in his restatement has suspected involvement of the petitioner as his son (victim) was allegedly in love with the sister of the petitioner and he used to talk with her. No other

Petitioner has got no criminal antecedent. Learned counsel appearing for the State as well as the informant oppose the prayer for bail.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Rohtas at Sasaram in Natwar Police Station Case No. 79 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
