JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Complaint Case No. 819 of 2017 registered for the offences punishable under Sections 498A/34 of the Indian Penal Code and Section 4 of Dowry Prohibition Act. Petitioner happens to be husband of the complainant and allegation against accused persons, including the petitioner is that they demanded Rs.3 lac, colour TV and Fridge from her and when she expressed inability of her father the accused persons assaulted her and on information her father came taken her to his house.
Submission of learned counsel for the petitioner is that the whole allegation is false and concocted and moreover

No.67658 of 2019(2) dt.24-10-2019 2/2 there is no specific allegation against the petitioner, rather there is general and omnibus allegation against all the accused persons. It is further submitted that even on notice by learned Sessions Judge the complainant has not appeared in court below. Heard learned APP also.
In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M., Vaishali at Hajipur, in connection with Complaint Case No. 819 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned and further condition that if complainant is ready to reside with the petitioner, he has to keep her with dignity and care.
