JUSTICE MADHURESH PRASAD ORAL ORDER 11-12-2019 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners seek bail in a case registered under sections 419, 420, 467 and 468/34 of the IPC.

Having no criminal antecedent, petitioners are in custody since 01.09.2019.

It is submitted by counsel for the petitioners that allegation of impersonation has been rejected only on account of suspicion being caused when biometric detail of the petitioners did not match at the time of preliminary test being conducted by the authority. Under similar circumstance, another co-accused Nikesh Kumar has been granted bail vide Cr. Misc.

Patna High Court CR. MISC. No.70391 of 2019(2) dt.11-12-2019 2/2 no.68013/2019.

Considering the aforesaid submissions, prayer for bail is allowed.

Let the petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bhagalpur in N.T.P.C. P.S. Case no. 45/2019 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioners who will give an affidavit giving genealogy as to how he is related with the petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the petitioners.

(2) That the petitioners will be well represented on each date and if he fails to do so on two consecutive dates, their bail will be liable to be cancelled.
