JUSTICE VINOD KUMAR SINHA ORAL ORDER 16-01-2020 This is an application for grant of anticipatory bail in connection with Majhaulia P. S. Case No. 45 of 2019 disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Recovery of 1000 liters of spirit from a Jhal Khumbi and it is alleged that spy has informed the name of the petitioner and other accused persons.

Submission of the learned counsel for the petitioner is that there is no source of identification is mentioned except that spy has informed. Considering the same, one of the co-accused has been granted privilege of anticipatory bail by this Court, vide order dated 24.10.2019 passed in Criminal Misc. No. 67970 of 2019.

Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Special Judge, Excise, Bettiah, West Champaran, in connection with Majhaulia P. S. Case No. 45 of 2019.
