Petitioner seeks bail in a case registered for the offences punishable under Sections 354, 354B/34 of the Indian Penal Code and Section 12, 18 of the of the Protection of Children from Sexual Offenses Act, 2012.

Informant is the father of the victim-girl, who has stated in his written report that while his daughter Moni Kumari, aged about 12 years was returning after completing her studies at 06:00 a.m., the accused surrounded his minor girl and used abusive and filthy language against her. After coming home, she narrated the incident to her father and thereafter the brother of the victim-girl went to the shop of accused Afroz Alam then he and other 20 to 25 unknown persons abused and assaulted him. No.11032 of 2018 (2) dt.27-02-2018 2/2 been submitted by the learned counsel for the petitioner that subsequently the matter has been compromised and good relation has been restored between the parties. None has suffered any injury in the said incident. It has been further submitted that the petitioner has got criminal antecedent and is in custody since 15.01.2018.

Considering the aforesaid facts and circumstances of the case, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Hathua Police Station Case No. 118 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
