Petitioner is an accused in a case registered for the offence punishable under Sections 376 and 420 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is also submitted that no sexual assault has been committed by the petitioner. In view of the statement of the victim under Section 164 Cr.P.C., that she has relation with the petitioner for last four years. She also stated that the petitioner did not have sexual relationship with her. It is further submitted that the victim is major in view of the date of birth. Petitioner is in custody since 20.08.2019. He has no criminal antecedent. Charge-sheet has already been submitted in the case and there is no allegation of tempering with the evidence.

Let the petitioner, mentioned above, be released on bail on furnishing the bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Ms. Madhvi Singh learned Judicial Magistrate 1st Class, Patna in Mahila Police Station Case No. 90 of 2019, on the following conditions:-
(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.
(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
