The petitioner seeks pre-arrest bail in connection with Purshottampur P.S. Case No. 56 of 2019, registered under Sections 399, 402 and 417 of the Indian Penal Code and 25(1b)a, 26 and 35 of the Arms Act. The accusation is that in course of patrolling duty six persons were seen, who started to flee away seeing the police party. On chase, the petitioner was apprehended with country made pistol and motorcycle.
Submission is that seized motorcycle is belonging to the petitioner and not the stolen material and petitioner, in the present case, is in custody since 08.07.2019. Having regard to the facts and circumstances of the

No.67393 of 2019(2) dt.11-12-2019 2/2 case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Purshottampur P.S. Case No. 56 of 2019 to the satisfaction of Shree Manoj Kumar, Judicial Magistrate, 1st Class, West Champaran at Bettiah, subject to the condition that out of two bailors, one must either be parent or close relative of the petitioner.
