====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 04-01-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 406, 420, 120B, 506, 34 of the Indian Penal Code.
3. Allegedly, an agreement was executed on 17.02.2023 and accordingly, the informant gave a huge amount to the accused persons through several modes, but later on, they neither executed the sale deed nor returned the alleged money to the informant.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. No such occurrence as alleged ever took place. He has been

The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He has been made accused in the present case merely because he is the owner of the land in question. Neither he has any connection with the agreement nor he is the witness of the same and without his consent and only with a view to pressurize him to sell the land, an amount of Rs. 20,00,000/- has been transferred in his account. It is further submitted that petitioner is ready to return the entire money to the informant which has been transferred in his account as mentioned in para 8 of the bail application. Petitioner has three criminal antecedents as mentioned in para-3 of this application.
5. Learned APP for the State as well as learned counsel for the informant opposed the prayer for bail.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on provisional bail for a period of four months, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with
Patna High Court CR. MISC. No.82044 of 2023(2) dt.04-01-2024 3/3 Chandauti P.S. Case No. 253 of 2023, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
7. After full and final payment of Rs.20,00,000.00 (Rupees Twenty Lakhs) within four months to the informant, the provisional bail of the petitioner will be confirmed by the learned Court below.
