19-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in relation to Falka P.S. Case No. 59 of 2017 registered under Sections 341, 323, 447, 448, 379, 307, 506, 34 of the Indian Penal Code, pending in the court of learned A.C.J.M. - V, Katihar. Learned counsel for the petitioner submits that prima facie the allegations against the petitioner are that of entering into scuffle with the wife of the younger brother of the petitioner. Learned counsel further submits that the nature of the injury found on the head of the injured Mehru Nisha has not been fully disclosed.
Learned counsel for the State is present and submits that there is an allegation of assault and causing
Patna High Court Cr.Misc. No.6964 of 2018 (2) dt.19-02-2018 fracture on skull bone of injured Mehru Nisha against the petitioner.
Considering the facts and circumstances particularly that there are allegations of assault causing injury on the vital part of the body of the injured, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail of the petitioner is rejected.
