The petitioner seeks regular bail in connection with Gaighat P.S. Case No. 383 of 2018 for the offence punishable under Section 392 of the Indian Penal Code.
The allegation is that while the informant was returning to Muzaffarpur from Darbhanga on his motorcycle, three unknown miscreants had stopped him and on pistol point, they snatched his motorcycle, one mobile and some cash. The learned counsel for the petitioner has submitted that the petitioner is innocent and has been falsely implicated in the present case inasmuch neither any T.I. parade has been held so as to connect the petitioner with the alleged crime nor any
Patna High Court CR. MISC. No.69719 of 2019(2) dt.13-01-2020 2/2 recovery has been made from the petitioner and he has been remanded in the present case after being arrested in other case. The petitioner is stated to be languishing in custody since 15.7.2019.
Having considered the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the fact that neither T.I. parade has been held nor any recovery has been made from the conscious possession of the petitioner, I deem it fit and proper to direct for release of the petitioner on regular bail. Accordingly, the petitioner, above named, is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-15th East, Muzaffarpur, in connection with Gaighat P.S.
