Mr. Rajendra Nath Jha ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 12-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Dhanrua P.S.Case No. 237 of 2016 registered under Sections 302 and 328 of the Indian penal Code. Allegation in brief is that informant's daugther was married with the petitioner 12 years back but after some years of marriage, a case was instituted by the wife against the petitioner and later on compromised was reached and at the time of occurrence, informant's daughter was living in her parents' house. IT is alleged that the petitioner had come to his in-laws house and given his wife two tablets to take when she gets ill. When informant's daughter took tablet started vomiting, she was brought to hospital for treatment but she died. Submission is that relationship between wife and the petitioner was strained, so a case was instituted by her under

Patna High Court Cr.Misc. No.12114 of 2018(3) dt.12-04-2018 2/2 Section 498A of the Indian Penal Code and the petitioner had not gone to in-laws place and not given any tablets. She consumed poison in her father's house and died there. However, there is no any evidence in the case diary to show whether she got treated to any hospital by her parents.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Vikash Kumar, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-XI, Patna in connection with S.Tr. No. 3 of 2018 arising out of Dhanrua P.S. Case No. 237 of 2016.
