The petitioner seeks bail in a case registered under Section 7 of the Essential Commodities Act.

Allegation is that 10 drums of kerosene oil is recovered from the vehicle.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 9.8.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is said to be the driver of the vehicle. He had only to transport the said kerosene oil in question. He had no knowledge for what purpose kerosene oil was being transported.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. East, Muzaffarpur in connection with Gaighat (Benibad O.P.) P.S. case No.92 of 2019.
