The petitioner seeks bail in connection with Dagarwa P.S. Case no. 200 of 2017 registered under Section 273 of the Indian Penal Code and Section 30(a) of the Bihar Excise and Prohibition Act 2016.

74.560 lts. of foreign liquor is said to have been recovered from Bolero vehicle and its driver namely, Bhushan Kumar and petitioner sitting in the said vehicle were apprehended. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his conscious physical possession. He has no concern either with the aforesaid vehicle or with the seized liquor. He happens to be

Patna High Court Cr.Misc. No.8936 of 2018(2) dt.19-02-2018 2/2 simple commuter of the same and was travelling in it without no knowledge of keeping the liquor in the said vehicle. He has no criminal antecedent. He has been languishing in custody since 08.12.2017.

In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Addl. Sessions-cum-Special Judge (Excise), Purnia in connection with Dagarwa P.S. Case no. 200 of 2017.
