2. Petitioner seeks regular bail in connection with Sessions Trial No.218 fo 2024 arising out of Khagaria(Muffasil) P.S. Case No.1048 of 2023, G.R. No.3476 of 2023 registered for an offence punishable under Sections 399, 402, 120B of the IPC and Section 25(1-b)a/26/35 of Arms Act.
3. As per allegation in the FIR, one loaded country made pistol, two live cartridges and three mobile phones have been recovered from the possession of the petitioner.
4. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. He next submits that petitioner is in custody since
Patna High Court CR. MISC. No.79094 of 2024(2) dt.07-02-2025 2/2 10.10.2023. He further submits that similarly situated coaccused person had already been granted regular bail by this Court vide order dated 15.03.2024 passed in Cr. Misc. No.16367 of 2024.
5. Learned APP for the State opposes the prayer for bail of the petitioner.

Considering the facts and circumstances of the case and also the fact that petitioner is in custody for more than one year and similarly situated co-accused person had already been granted bail by this Court, let the above named petitioner, be released on bail, in connection with Sessions Trial No.218 of 2024 arising out of Khagaria(Muffasil) P.S. Case No.1048 of 2023, G.R. No.3476 of 2023 on furnishing bail bonds of Rs. 10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge IIIrd, Khagaria.
