2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 341, 323, 324, 379, 447, 504/34 of the Indian Penal Code.
3. As prosecution case, the allegation against the petitioner is of assaulted the informant by means of farsa and co-accused Madan Lal Das snatched her golden chain.
4. It is submitted by learned counsel for the petitioner that the case is of year 2013, after investigation police has filed the charge-sheet under Sections 323, 341, 324, 308/24 of the Indian Penal Code but the court below has differed the chargesheet taking cognizance against the petitioner under Sections 323, 341, 324, 308 of the Indian Penal Code. He further submits
Patna High Court CR. MISC. No.77895 of 2023(2) dt.08-12-2023 2/2 that till date petitioner has not received the notice from the court below mentioned in Para 10 of the bail application. He further submits that injury was found to be simple in nature mentioned in Annexure-3 of the bail application.
5. Learned APP for the State opposes prayer for anticipatory bail.
6. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in connection with Chhatapur P.S. Case No. 265 of 2013, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
