JUSTICE MADHURESH PRASAD ORAL ORDER 10-12-2019 Heard learned counsel for the petitioners as well as learned Addl. Public Prosecutor for the State. Petitioners seek bail in a case registered under sections 304B, 201/34 of the IPC.

It is submitted by counsel for the petitioners that petitioners have been falsely implicated in this case. Charge sheet has also been submitted under sections 364 and 498A/34 IPC. Petitioner nos.1 and 2 are custody since 25.10.2018 and 26.10.2018 respectively. There are four children out of the said wedlock and marriage has taken place long back in the year 2010.

It is further submitted that investigation in respect of other accused is still going on. Case diary reveals that various

Patna High Court CR. MISC. No.67450 of 2019(3) dt.10-12-2019 2/2 persons supported the allegation in respect of petitioner no.1. Considering the rival submissions, prayer for bail of petitioner no.2, being father-in-law is allowed. Let petitioner no. 2 (Lalan Rabidas) be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate XI, Bhagalpur in Pirpainti (Bakharpur) P.S. Case no. 200/2018 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.

Prayer for bail of petitioner no.1 (Kanhai Rabidas @ Kanhaiya Ravidas) is rejected for the present. (Madhuresh Prasad, J) s.hassan/- U T
