JUSTICE ARUN KUMAR ORAL ORDER 17-02-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Sanjhauli P.S.Case No. 59 of 2017 registered under Sections 302/34 of the Indian penal Code.

Allegation in brief is that informant's son was found thrown nearby a pond and suspicion is raised that accused persons killed him for the reason that once wife of Dharmendra Musahar, the accused, had eloped with the deceased.

Submission is that informant is not an eye witness only suspicion is raised due to previous enmity with Dharmendra Musahar except that there is no evidence against the petitioners and they are brothers of Dharmendra Musahar and police has completed investigation.

Having considered the aforesaid facts and circumstances,

Patna High Court Cr.Misc. No.4189 of 2018 (3) dt.17-02-2018 2/2 the petitioners, namely, Ghoghiya Musahar and Sethwa Musahar, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Sessions Judge-IV, Sasaram (Rohtas) in connection with S.Tr. No. 398 of 2017 arising out of Sanjhouli P.S.Case No. 59 of 2017.
