The petitioner seeks bail in connection with Complaint Case No.467C of 2009 in which cognizance has been taken under Sections 302/34 of the Indian Penal Code. 3.

The allegation against the petitioner is to have committed murder of son of the informant. 4.

Learned counsel appearing on behalf of the petitioner submitted that petitioner has falsely been implicated in the present case. It has further submitted that accusation against this petitioner was found false during investigation and

It has further submitted that similarly situated co-accused person has already been granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 27185 of 2012 on 02.08.2012. It has further submitted that the petitioner is a man of clean antecedent and he is in custody since 10.07.2023.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and similarly situated co-accused person has already been granted bail by co-ordinate Bench of this Court, let the petitioner, above named, is directed to be released on bail in connection with Complaint Case No.467C of 2009 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge - VII, Khagaria.
