====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-02-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for offence under Sections 302/34 of the Indian Penal Code.

3. As per prosecution case, this petitioner alongwith other co-accused persons named in the F.I.R. assaulted informant and his father, as a result of which, father of informant died. This petitioner is alleged to have given repeated blow with knife on the head of father of informant.

4. Learned counsel for the petitioner submits that as per F.I.R., this petitioner and co-accused Satyendra Rai and Kishundeo Rai assaulted father of the informant with their respective arms, on account of which, father of informant died,

Patna High Court CR. MISC. No.77825 of 2024(3) dt.14-02-2025 2/2 but post-mortem report does not corroborate the prosecution case. As per post-mortem report, only two incised wound has been filed on the person of deceased, which itself falsifies the prosecution case. Petitioner is in custody since 02.07.2024. Chargesheet has been submitted.

5. Learned A.P.P. for the State and learned counsel for the informant opposed the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Vaishali at Hajipur in connection with Ganga Bridge P.S. Case No. 226 of 2023.
