The petitioner seeks pre-arrest bail in connection with Pipra P.S. Case No. 173 of 2019 registered under Sections 341, 323, 324, 307, 354, 379, 504, 506 and 34 of the Indian Penal Code.

The accusation is that the she buffalo of petitioner and three others, named in the first information report, were grazing the vegetables in the field of informant, Subhash Yadv. On protest, Umesh Yadav, Shravan Kumar, Ranju Devi and petitioner, variously armed with weapon, came there and started to abuse. When son of the informant, namely, Ranjan Kumar, rushed to save the informant, then, he was also assaulted through dabia by Umesh Yadav in which he sustained cut injury on his head. When Anita Devi, wife of the informant, reached there, then, her saree was pulled with bad intention by the

Patna High Court CR. MISC. No.68109 of 2019(2) dt.15-11-2019 2/2 petitioner and petitioner also snatched her gold chain. At that time, Sharavan Kumar caused injury at the left palm of the another daughter of the informant.

Submission is that in fact due to grazing of the she buffalo, hot exchange of words took place, as detailed in the first information report, but, petitioner being the family members of other co-accused, has also been implicated in this case with allegation of unfolding the saree of the wife of the informant. Petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Pipra P.S. Case No. 173 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, VI, Supaul, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
