2. The petitioner has prayed for bail in connection with Barauni GRPS (Barauni Rail) P.S. Case No. 242 of 2024 registered for the offence punishable under Section 309(4) of B.N.S. and charge sheet has been submitted under Sections 309(4), 317(2), 127(2) of B.N.S.
3. The case of the prosecution is that some unknown miscreants hired the car of the informant for going to Madhubani. It is further alleged that after some distance two persons directed her to follow their directions on the knife point. Finally, they took away the car and the mobile of the informant.
4. Learned counsel appearing on behalf of the petitioner
Patna High Court CR. MISC. No.73518 of 2025(2) dt.09-12-2025 2/2 has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. His name has surfaced during investigation in the confessional statement of one Subhash Kumar. It has also been submitted that the stolen mobile was being used by one Ranjit and Ranjit has disclosed that he has purchased the same from the petitioner. Nothing has been recovered from the possession of this petitioner. He is languishing in judicial custody since 14.06.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail has submitted the petitioner is having criminal antecedent of four cases.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Barauni Rail (Barauni Railway)in the district of Begusarai in connection with Barauni GRPS (Barauni Rail) P.S. Case No. 242 of 2024.
