JUSTICE BIRENDRA KUMAR ORAL ORDER 21-03-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner is languishing in custody for the offences punishable under Sections 143/384/387/435 of the Indian Penal Code and Section 27 of the Arms Act.
According to FIR, two persons including the petitioner had demanded ransom from the informant, who is also a contractor. Co-accused Anjani Kumar has already been allowed bail under Section 167(2) Cr.P.C. as informed by the learned counsel for the petitioner. Petitioner is in custody since 11.01.2017.
Earlier prayer was refused on 10.04.2017 in Cr. Misc. No.14464 of 2017 with direction to the learned trial Judge to
Patna High Court Cr.Misc. No.5479 of 2018 (4) dt.21-03-2018 P2/ expedite the trial. The report of the learned trial Judge would reveal that the matter is pending for defence evidence. The learned trial Judge is directed to conclude the trial within two months from the date of receipt of a copy of this order, failing which the petitioner would be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Khiri More P.S. Case No.3 of 2016, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
