JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2019 This application, for grant of anticipatory bail, arises out of Chakia P.S. Case No. 179/2019, disclosing offences under Sections 341, 323, 324, 307, 393/34 of the Indian Penal Code. Petitioner is named in the F.I.R. and there is allegation as per F.I.R. is that some miscreants came and snatched away Rs. 6500 and mobile from the informant and one person was caught on spot, who disclosed the name of petitioner and another as his associated.

Submission of learned counsel for the petitioner is that the F.I.R. is not clear as to how the name of petitioner transpired and he has falsely been implicated in this case. Heard learned A.P.P. also.

Having heard both sides, it appears from the impugned order that name of the petitioner has been disclosed

No.68007 of 2019(2) dt.25-10-2019 2/2 by the co-accused persons and the materials have also come against the petitioner during course of investigation, as such, I am not inclined to grant the privilege of anticipatory bail to the petitioner rather petitioner has to surrender before the court below and make prayer for regular bail and if any such application is filed, the court below will dispose of the same on the merit of the case, without being prejudiced by this order.
