The petitioner apprehends his arrest in connection with Karjain P.S. Case No. 67 of 2019, registered under Section 307 and other allied Sections of the Indian Penal Code. The accusation is that when the informant, Anil Kumar, woke up early in the morning of 25.07.2019 then he saw that 20 to 25 persons present at his field variously armed with weapons, on which, he reached there and made query. At that time, Nitish Kumar pointed gun at his father, Anirudh Mehta and petitioner gave farsa blow at the head of his father, Anirudh Mehta then he fell down. In the meantime, his aunt Sabita Devi and other family members reached there then Prakash Mehta and Vinod Mehta started to abuse his aunt, Sabita Mehta and they also snatched her gold chain. At that time,

Patna High Court CR. MISC. No.70438 of 2019(2) dt.19-11-2019 2/2 Jagdish Mehta, Arbind Mehta, Kapileshwar Mehta and Umesh Mehta were also indulged in abusing and causing assault. Learned counsel for the petitioner submits that, in fact, occurrence took place due to land dispute, in which, petitioner's side also sustained injury, regarding which, Karjain P.S. Case No. 68 of 2019 is also instituted on the basis of written report of co-accused, Kaplileshwar Mehta. Moreover, only one incised wound was found on the person of Anirudh Mehta, father of the informant but it is not detailed that the injury was found at his head. Further submission is that petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned J.M. Ist Class, Birpur, Supaul, in connection with Karjain P.S. Case No. 67 of 2019, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
