JUSTICE ARUN KUMAR ORAL ORDER 06-02-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Rohtas PS Case No. 353 of 2017 registered under Sections 147, 148, 149, 341, 323, 307 and 504 of the IPC.

The allegation in brief is that all the accused persons, due to land dispute, abused and assaulted the informant and specific allegation against the petitioner is that he gave spade blow over his head.

Learned Counsel for the petitioner submits that both sides are agnates, there is land dispute, case and counter case between the them. The allegation is of giving only one single blow, the dimension of the injury was 1/2X1/2X1/2, the doctor has found the injury simple but kept the opinion reserved and both sides have entered into compromise.

Having considered the said facts and circumstances, the petitioner, namely, Ajay Sah is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Kavindra Kumar, Judicial Magistrate, Dehri, District Rohtas in connection with Rohtas PS Case No. 353 of 2017.
