JUSTICE BIRENDRA KUMAR ORAL ORDER 08-02-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is in custody in connection with Raghopur P.S. Case No.100 of 2017, a case under Sections 406, 409, 420, 467, 468, 471 and 120(B) of the Indian Penal Code. The F.I.R. discloses non disbursement of flood relief amount to the deserving people.

Submission of the learned counsel for the petitioner is that the petitioner was Nazir and his duty was only to process the file. Co-accused Niranjan Kumar, who was the Circle Officer has already been allowed bail by a coordinate Bench of this court in Cr. Misc. No.2427 of 2018. Further submission is that in fact some of the beneficiaries were paid twice money of the relief fund,

Patna High Court Cr.Misc. No.7832 of 2018 (2) dt.08-02-2018 2/2 which has already been recovered and recovery is also going on from others.

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with the aforesaid case, with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
