The petitioner, who is in custody since 19.06.2019, seeks bail in connection with Kudra P. S. Case No. 71 of 2015 (G. R. Case No. 618 of 2015), instituted for the offences under Sections 409 and 420 of the Indian Penal Code.

From the F.I.R. it appears that Shanti Mini Rice Mill was provided with procured paddy for delivering Custom Milled Rice (CMR) to the Bihar State Food and

Patna High Court CR. MISC. No.67998 of 2019(2) dt.04-12-2019 2/3 Civil Supplies Corporation. When the same was not being supplied on time, a physical verification of the stock of the aforesaid rice mill was made and it was found that no paddy or the Custom Milled Rice was available.

Hence, the F.I.R.

During the course of investigation, it was found that the petitioner in his capacity as Circle Officer had verified and had assessed a particular value of the land which had been pledged as security with the Bihar State Food and Civil Supplies Corporation. On this ground, namely, of the petitioner having furnished a collusive report about the surety provided by such millers, he has been made accused in several cases of similar nature and he is being remanded in all such cases successively and consecutively. In the present case, the petitioner appears to have been remanded on 19.06.2019.

Learned counsel for the petitioner submits that there is no collusive report submitted by him and it is

Patna High Court CR. MISC. No.67998 of 2019(2) dt.04-12-2019 3/3 only on the basis of the information provided by the Halka Karmchari that such a report was given. Considering the nature of accusation against the petitioner and his period of custody, this petition is allowed.

The petitioner, above-named, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate-I, Gaya in connection with Kudra P. S. Case No. 71 of 2015 (G. R. Case No. 618 of 2015). (Ashutosh Kumar, J) skm/- U
