Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act. 3.
The learned counsel for the petitioner submits that OP No. 2, despite receiving notice validly, chooses not to appear and contest. It is next submitted that petitioner, being husband, has been falsely implicated in the instant case. It is also submitted that a supplementary affidavit has been filed wherein the photographs of the OP No. 2 with her lover have been annexed. It is next submitted that petitioner objected the relationship of the OP No. 2 with the boy with whom her photographs went viral on social
Patna High Court CR. MISC. No.81568 of 2023(5) dt.25-06-2024 2/2 media as such the OP No. 2, being angry with the conduct of the petitioner as he reprimanded her, instituted the instant false case. 4.
Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Complaint Case No. 123 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. 6.
However, the OP No. 2 shall be at liberty to file an application seeking cancellation of anticipatory bail granted to the petitioner in the event if the petitioner has obtained anticipatory bail by misleading the Court.
