JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Pipra P.S. Case No. 207 of 2019, registered for the offences punishable under Sections 147, 149, 341, 323, 324,325, 307, 379, 354, 504, 506 of the Indian Penal Code. As per F.I.R petitioner No. 1 is said to have assaulted by Farsa to the elder son of informant and petitioner No.3 assaulted by Gandasi to the son of informant namely Manoj Kumar and petitioner no.3 is also named in the F.I.R along with other co-accused.
Submission of the learned counsel for the petitioners is that they are Gotiya and there is land dispute between them
Patna High Court CR. MISC. No.69440 of 2019(3) dt.18-11-2019 2/2 and there is case and counter case between the parties and injuries are simple in nature except injuries of one Bhagirath Mahto but the said allegation of assault is attributed against other accused person.

Having heard both sides, considering the above submission, this application allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) each with two sureties of the like amount to the satisfaction of learned CJM, Motihari, East Champaran in connection with Pipra P.S. Case No.-207 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immovable property within the jurisdiction of the Court concerned.
