The petitioner, already in custody, seeks bail in connection with Complaint Case No. 14539 of 2014 registered under Section 304/34 of the Indian penal Code. Allegation in brief is that complainant's disabled son was taken to police station by A.S.I. Bikram Singh and there Bikram Singh and the petitioner strangulated the son of the complainant by a rope thereafter he underwent treatment for a month and after a month he died. .

Submission is that the complaint was lodged after lapse of a month from the date of alleged occurrence and subsequently after death of the complaint's son she also lodged police case and the police submitted final form and as per

Patna High Court Cr.Misc. No.21178 of 2018(2) dt.11-04-2018 2/2 postmortem report, death is due to respiratory failure. Learned counsel also seeks bail of the petitioner on the ground of parity as Bikram Singh against whom allegation is more serious has been admitted to anticipatory bail by a co-ordinate Bench of this Court vide order dated 04.04.2018 passed in Cr. Misc. No. 60997 of 2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely , Deepak Sah, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned ACJM-IV, Begusarai in connection with Complaint Case No. 14539 of 2014.
